Terms of Service for Balance

Welcome to Balance! These Terms of Service ('Terms') govern your access to and use of the Balance mobile application and related services (collectively, the 'Service') provided by Balance ('we', 'us', or 'our').

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Account Registration and Eligibility

• To use the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
• You must be at least 18 years old to use the Service. By registering, you represent and warrant that you are 18 years of age or older.
• You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your password or account or any other breach of security.

2. Use of the Service

• Balance is designed to help couples manage their personal finances. It allows you to track expenses, create budgets, set financial goals, and view financial summaries.
• You agree to use the Service only for lawful purposes and in accordance with these Terms.
• You may not use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Service.
• You are solely responsible for all financial data you input into the Service. We do not verify the accuracy of your financial data.

3. Shared Accounts and Data

• The Service allows you to link your account with a partner to create a shared financial view. By linking accounts, you acknowledge and agree that certain financial data (such as expenses, incomes, and budgets) will be viewable and editable by your linked partner(s).
• You are responsible for choosing the individual(s) with whom you share your financial data and for any actions they take within your shared account.

4. Data Security and Privacy

• We employ reasonable security measures to protect your data as described in our Privacy Policy. However, no internet transmission is completely secure.
• By using the Service, you consent to our collection and use of your data as described in our Privacy Policy.

5. Intellectual Property Rights

• All content, features, and functionality of the Service, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Balance, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• These Terms permit you to use the Service for your personal, non-commercial use only.

6. Disclaimers and Limitation of Liability

• THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY, NON-INFRINGEMENT, AND FITNESS FOR PARTICULAR PURPOSE.
• WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.
• IN NO EVENT WILL BALANCE, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SERVICE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

7. Indemnification

You agree to defend, indemnify, and hold harmless Balance, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

8. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country.

9. Changes to Terms

We may revise and update these Terms from time to time in our sole discretion. All changes are effective immediately when we post them. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.
